Dear Dayarama Das,
Hare Krishna
All Glories to Srila Prabhupada
This is with reference to your emails dated 10/06/2011 and 14/06/2011, addressed to the President of our Society, which has been brought to our notice.
Unfortunately, your emails are a mischievous attempt on your part to somehow or the
other take control and possession over the property and temple belonging to our
Society despite the order of the Hon'ble Supreme Court. Your emails deliberately
wrongly portray and misinterpret the Court order and misrepresent Court proceedings.
In view of your attempt to take possession of the Bangalore temple and property
under the guise of the so called Supervisory Committee (the constitution of which
itself is wholly illegal and not even as per the bye-laws of ISKCON, Bombay), having
been prevented by the order of the Hon'ble Supreme Court directing status-quo, it is
apparent that you have resorted to making false assertions about the proceedings
itself with a view to somehow or the other get around the effect of the order of the
Hon'ble Supreme Court. Your say that their Lordships orally observed that the
Supervisory Committee should continue is totally false.
On the other hand, their
Lordships' very clearly observed, which is ultimately reflected in the Court Order
itself, (which was passed at the end of the proceedings after various exchanges of
arguments and interjections from both sides) that status-quo be maintained and that
the Bangalore Society carry on the day-to-day affairs (being in control and
possession, which was the status even as on the date of the order of the Hon'ble
Supreme Court, as acknowledged even by your counsel). Therefore there is no
question of the Court allowing or continuing with the so-called supervisory
committee or making any observations to such effect.
In the light of this, your false assertions to the contrary and to the effect that
as if the Hon'ble Supreme Court has permitted the Supervisory Committee to continue
is wholly erroneous and is nothing but a mischievous attempt on your part to
misrepresent the Court order and proceedings to the local enforcement authorities
here and an attempt to confuse them to get them to help you in your unlawful
designs.
Please note that any attempt on your part either as the Supervisory Committee or
otherwise to enter the temple or the premises of the Society to carry out so called
"duties" as per the so called "bureau resolution" or to do any other act would be
nothing but a willful disobedience of the order of the Hon'ble Supreme Court to
maintain status-quo and amounts to contempt of Court and you are hereby required not
to attempt any such act as threatened by you in your email.
It is unfortunate that though the Hon'ble Supreme Court expected the parties to make
an attempt to have the dispute amicably resolved, instead of doing so, you have
addressed such mails which only add to heightening the dispute, attempt to
unnecessarily disturb the peace, will precipitate matters and amount to contempt of
Court. Please note that if you resort to any such acts as threatened in your mails,
you will be guilty of violating the order of the Hon'ble Supreme Court both in
letter and in spirit and we will be constrained to bring the same to the notice of
the Hon'ble Supreme Court.
Yours sincerely,
Suvyakta Narasimha Dasa
